2. Application of Law to Facts

 

National publicity followed the announcement of the jury verdict in December of 1996. See, e.g., Diana B. Henriques, Big Jury Award in Injury Case Over Keyboards, N.Y. Times, December 10, 1996, at D1; Jon Auerbach and Laura Johannes, Digital Equipment Loses Verdict on Carpal Tunnel, Wall St. J., Dec. 10, 1996, at B4. The news of Ms. Geressy’s nearly $5.3 million verdict against defendant reached Gary S. Gevisser, Chief Executive Officer of Sunmed, Inc. (formerly known as Injury Evaluation Consultants (IEC)) in Las Vegas, Nevada. The information struck Mr. Gevisser as particularly noteworthy because, before the litigation had been commenced, doctors from his company had examined Ms. Geressy, prepared a medical evaluation on her condition for The Port Authority of New York and New Jersey (the IEC Report) and, contrary to the jury finding at trial, had determined that her ill health was unrelated to her work. See Affidavit of Kenneth J. King, sworn to March 25, 1997 ¶¶ 10, 11, Exhibit A (King Affidavit). Mr. Gevisser contacted Digital Equipment Corporation to explain his knowledge of the Geressy case and his company’s own information regarding Ms. Geressy. See King Affidavit ¶ 11. Defendant then subpoenaed the IEC Report and filed the instant motion for a new trial based on discovery of this evidence.

 

There is also a judgment, which I have yet to see, attorney David Winterton received of some US$250,000 on behalf of Derrick Beare of Investec against Ms. Cusimano’s former company that owned the rights to all these technologies that DAAC investigative journalists like Diana Henriques of the New York Times, herself a chronic sufferer, AS WELL, of a repetitive-stress-injury disorder, have so very carefully chosen to ignore despite again, Ms. Henriques featuring so very prominently, just like me, in very famous Federal Judge Weinstein’s rather important decision that resulted in some 2,000 similar class action lawsuits being placed on “deep freeze ice” which of course didn’t prevent defense attorneys from all over the world, causing my phone to “ring off the hook”.

 

I think you would understand why Mr. Newell Starks, an officer of the enormously successful leverage buyout arm of Citigroup, Citicorp Venture Corporation, specializing in “management friendly”, i.e. “shareholder hostile” takeovers, placed my one-third interest in all Ms. Cusimano’s intellectual property as well as her two-thirds interest in Sunmed referenced clearly in Judge Weinstein’s opinion, at just shy of a half a billion United States Dollars; and you will recall the purchasing power of the Almighty U.S. Dollar back in April 1997 was a little more than it is today.

 

BTW are you considering growing like my wife and me your own alfalfa sprouts which taste a whole lot fresher because they are than what you buy in most organic stores?

 

Would you understand how easy it was for me to “walk away” from partnering with very bright but crooked Ms. Cusimano PhD in what could very possibly have been the most significant IPO in the history of Wall Street given how just two years prior I turned down the second opportunity I was afforded by my uncle David Gevisser to become the American head of the DeBeers-Anglo American Cartel where as you can understand not only is “money no object”, but no senior ranking member of the DAAC even think in monetary terms when performing their two busy jobs; again, first, where to vacation; and second, who to kill once an individual “refuses” their straightforward, easy to understand agenda:

I did offer Mr. Starks a “double or quits” bet on the US$40,000 I loaned him in May 2001

to cover a life insurance premium payment as well as his family’s over-the-top psychologist bills in the event that my French-Canadian wife decided to purchase within a 12 month period her own Lear Jet.

 

For “sum” [sic] reason even though Marie Dion Gevisser assured Mr. Starks that she was not going to be talked in to such a purchase, this gentleman credited with having invented the notebook computer when working as an engineer for Texas Instruments decided to turn down my rather generous offer.

 

By the way, MDG mentioned again last night that she may very well decide to launch her own BLOG website to compete with me if I keep bringing her up in my emails which she says she does not read and I have no reason to doubt her given how very little time she has “on her hands”.

 

Quite frankly I am quite confident my very sexy wife would get a whole lot more viewers assuming I am not allowed to place up on my websites more photos of her nude.

 

I suggest that it is also newsworthy that accountant Mr. Jeffrey Malatskey a long time buddy of mine like Roy Essakow from Carmel College, Durban, South Africa, now at partner in charge of the ING account at the criminal enterprise of Ernest and Young, went for a period of almost 3 years “deafening silent” on me following my simple question on July 16th 2002 in response to his immediately prior very friendly email, my email ending with a rather non-threatening and very easy to understand question:

 

Jeff, could you explain to me why a publicly traded company should be valued any more than a private company?

 

Of course you would understand perfectly well if you had the intelligence which affords you patience given how an intelligent person has much more time since there is so much more time when not watching TV and the such to in addition to exercising and of course making lots of love to the most beautiful French-Canadian in the world to go and look what was happening to the share price of ING in mid July 2002 as it “tanked” that some 7 odd days later, on July 23rd 2002 had me issue a very “public statement” 267 odd word “risk assessment”, edited of course by very literate businessperson and legal scholar Mr. Jeffrey R. Krinsk Esquire of Finkelstein & Krinsk.

 

Mr. Malatskey, like Ms. Cusimano, like Mr. Ron Bellows and all those too busy keeping track of their lies from day one keep forgetting the awesome power of the Internet that affords each one of us to keep track of not only what is said but what is not said and then to be able to deduce rather easily for example why someone like Mr. Malatskey would begin communicating with me again on June 19th 2005, his entire 969 odd word email follows:

I recently spent some time with Raymond Oshry who tells me that he saw you

in London and spent time with you.  Given what he told me I thought I would

try and communicate with you by email in the first instance and ask for your

phone number so that we can perhaps talk.

 

As you know there are a number of ex South Africans living here in Sydney

including Irvin Strouss and Ivan Oshry - I had learned indirectly from them

(and directly from some of our other mutual friends in the USA) some time

ago that you have become somewhat disturbed and that you spend many hours

ranting and raving by email covering a range of topics and being quite

insulting to many many people.  I was also warned off against communicating

with you in that you have earned yourself a reputation for turning on people

for reasons only known to yourself, that you copy/pass on everything that is

communicated to you, and that you even go so far as to cut and paste or make

changes to emails sent to you before you send them on to a wide number of

people who are on your email lists.

 

To be honest I didnt know what to make of what people were saying until I

had the misfortune to read some of it myself, and I must admit it did take a

little while to start to somewhat understand things because notwithstanding

the vast majority of strange conspiracy type stuff you write about and about

which I have little knowledge, there were some things about Durban you wrote

of which made a bit of sense and contained elements of what might be

credible or believable at first blush, but not after a few more sentances. 

Ive now also seen for myself what others talked about and how many people

spent fruitless hours trying to extricate themselves from your email webs.

 

The reason I have decided to try and make contact is that Raymond Oshry told

me that you appeared sane and capable of understanding things

notwithstanding that in any conversation you couldnt really contain yourself

and did eventually return to your various theories about how almost everyone

youve come into contact with or read about is somehow a crook.

 

I'm not sure whether you are going to act true to form on this one, or which

Gary I will find myself communicating with, the one I grew up with and

admired and respected, or the one who is choosing to take pot shots in all

directions.  To be honest I dont care that you demonstrate in writing to the

whole world that you have absolutely no respect for your parents and family

(near or related), that you are so very possessed and absorbed in rubbishing

everything about your home town Durban that allowed you to achieve the

greatness that you no doubt revel in today, that in seeking to destroy other

peoples names and reputations you demonstrate that you have little regard

for your own - that your writings appear to suggest and provide living proof

of a perverted sick mind, but I do very much care that in all your various

diatribes, you referred to me in any manner.

 

I can see that others have threatened you in trying to persuade you to

desist from your path and that has clearly not worked so no point trying

that.  You obviously really do believe that playing tricks with words and

developing threads and nuances and puns somehow makes you smarter than

others and something more than the simply average student that the Durban

Jewish day schooling system produced.  Do you really believe that your

capacity to understand everything is so much greater than everyone elses -

you,like me and many others, were and are still average in many many ways,

and as much as you now try to disconnect from your past, cannot do so and

are trapped by that fact - yes you grew up in Durban, you benefitted from

apartheid just like everyone else, and only became so religiously zealous

once you were safely far away from South Africa.  If you were a real hero

you would have used your mightly pen there and then not here and now like a

miserable coward.

 

What I will do is  ask you very nicely to go and do some editing in your

system and remove all references to me.  Why on earth would you say such

terrible things about someone that you went through all your schooling with,

who you had stay with you in your apartment in 1981 in San Diego, whose wife

you were good friends with too, who protected you from the shopkeeper who

wanted to have you arrested those years ago in Bloemfontein on a school tour

for throwing dangerous fireworks into his home, who used to go to bat for

you when your mouth got you into trouble with the bigger boys, and I could

go on and on.

 

Gary the rubbish you have written about me and university is just that -

rubbish and more rubbish but obviously you believe you can say and write

what ever fiction you like about anyone as your track record demonstrates.

 

You have a chance to prove that you are not a completely sick mind by

responding directly to me and not copying the world. Please take a moment to

think of what you have said/written and the potential repercussions for me,

Estelle and my entire family.  If youre unable to do that it is possibly

because you dont have kids of your own - maybe there is a god after all -

sparing us all from another generation of your genes.

 

I await your response and we'll take things from there shall we.

 

Shall we simply wait for people like Mr. Malatskey and Co. never to forget both the DAAC media and DAAC academia all so transparently intertwined with the DAAC’s politicians all paid for in untraceable Diamond Currency, all of them talking out of both sides of their mouths all the while thinking they are so very godly that the day of judgment would never arrive when we could all just kick back and watch and have them explain in “real time”, like right now, why it is they keep getting more than their fair share of the graft-spoils of Diamond drilling bit Oil wars to continue their evil ways as this spotlighted group of hypocrites make their way “back and forth” to their so very corrupt religious establishments, academia of course the new corrupt church, which serve only to make more corrupt business connections?

 

What an awesome time to be alive without the slightest of fear exposing all their “shortcomings”.

 

Cant you just wait for the first student at any university/college in the world to raise their hand at a lecture and question their professor beginning with what all the fuss is about nudity and “bad language” while no member of academia has thought it important to write a paper on the strong alliance between church, state and academia throughout the western world in support of the DAAC’s South African Apartheid Regime transferring most importantly the gold and platinum out of South Africa at not close to “fair market price”, destination the United States, for a period of some 45 odd years?

 

Moreover, to have the professor pass an opinion where that gold as well as diamonds used to finance Hitler can be found today?

 

Furthermore, what someone like Marc Rich would have to say about where that gold is today buried?

 

Mr. Malatskey was with me on the 4 month Ulpan at Sde Boker located in the Negev desert of Israel, near Beersheba, that began on September 1st, 1972, some 3 odd day before DAAC financed PLO terrorists, backed to the hilt by the DAAC House of Saud backed up by Sec. of State James A. Baker’s law firm, began to brutally murder 11 defenseless Israeli athletes at the MUNIch Olympic Games.

Mr. Malatskey was a well above average student as well as sportsman.

 

In fact while he was a horrific cricketer he was one of the very best ruby players even though his ball handling was about as good as an ant, at least relatively speaking when say compared to mine or someone like Roy Essakow who was in fact one extraordinarily smart rugby player who played the 8th Man position at the bottom of the scrum very brilliantly including coming to my assistance on one occasion after I had broken the nose of the opposing “hooker” who was absolutely silent when a teammate of his, very possibly playing in the opposite position to Roy Essakow, shouted out as the ball was placed in to the scrum by one of the scrumhalfs, “Bloody Jew”, my patient and so very deliberate decision to wait until the scrum broke up to first knock the wind out of the hooker so that when I delivered the perfect left to his nose, the crunch like music to my ears there would be absolutely no noise interference and at the same the rest of his teammates beginning with their number 8 got the message loud and clear but obviously a little too loud and clear since I was the only player standing with the opposing hooker’s blood all over my hands and rugby shirt.

 

Thank God for Roy Essakow is all I thought about at the time.

 

But as an academic Roy was no better than ant, in fact it would be an insult to the dumbest of ants to place an ant in the same category of intelligence of either Roy or his elder brother Jeffrey who while a couple of years ahead of me at university I had to coach through Deceased and Insolvent Estates which we both took together; the Essakow boys again very possibly the two dumbest Jewish people who have ever in the history of the Jewish people been placed on earth by an extraordinarily smart and vengeful God.

 

Jeffrey Essakow, by the way, was also an excellent rugby player which in my humble but seasoned opinion is a far better test of intelligence than an IQ test; just look at Dr. John K. Pollard and each and every member of the faculties of all the Ivy League Universities, the intellectual midgets that they are, now pulling out all stops to bail out gang-bangers from prison for fear when I communicate with them in prison they might decide to attend upon their release one of my Educational Light Journey-One Tribe of Achievers seminar-workshop.

swimming out to sea directly in front of the Cliff House propelled mostly, I assume, by his farts, and if not then he could still be the person most responsible for the sound barrier we keep hear being broken, more so than ever.

 

Mr. Malatskey like most on that “soul-tit-searching” Ulpan never gave much thought over the years to all that was “accomplished” back then until such time as I began writing about my experiences with this Perspective One that I “gifted” my one-time amazing father Bernie Gevisser on October 18th, 2000 to commemorate his 77th Birthday.

 

Not to mention my father still very possibly at this hour over there in Melbourne, Australia, my sister Kathy-Louise now having him in a straightjacket, thinking why my highly secretive Royal Mater-Mother never once told him about Mr. Jost, her one very “closed lip” Zurich, Switzerland based private banker, all the while my father “sumhow” [sic] thinking it smart to hand over, very recently, to my RM the keys to my bachelor pad in Seapoint Cape town without even first asking me who more than any other member of my immediate family is responsible for my dad during all the 30 years he was married to my mother, able to hold his head so very “proudly”.

 

Deciding to “go to war” with me takes only stupidity and of course my father has the excuse of starting his downward spiral in preparation to return as an ostrich and a stupid one at that, when his dying mother’s one brother attacked my dad right after he returned from World Oil War II with a knife; the moron Louis Sher blaming my dad for Louis’ sister contracting cancer, “worrying to death” about her favorite son dive-bombing the crap out of the DAAC Nazi bastards while following orders shared with the DAAC Nazi bastards issued by the DAAC Allies.

 

My Royal Mater on the other hand is much like my wife, and since my father obviously survived the attack felt he should have got on with his life while not forgetting for a moment that my Royal Mater was raised by Nechie Badash, Zena’s paternal grandmother who watched helplessly from inside a closet as her entire immediate family had their throats slit by a gang of marauding Cossacks on a night out having fun killing Jews.

 

It is possible that Mr. Malatskey had forgotten how we all sat cross-legged on the small green patch of grass outside David Ben Gurion’s most humble home back on November 1st 1972, 13 months to the day from when the Mossad stopped reporting to Ben Gurion since this great friend of Nechie Badash who declared, “Let the Children of Israel Be A Light Unto The Nation”, passed away on December 1st, 1973 shortly after the disastrous Yom Kippur War that meant so very little to all Jewish people in the Diaspora including those who attended Ulpan’s in Israel, a fact of life not lost on those raised to forgive but never forget.

 

But Jeffrey Malatskey might remember how well I “faired” at Sde Boker’s shooting range as well as the 98% almost perfect marks I achieved in our final exams.

 

Someone like Mr. Malatskey would have also done well in the academics but not close to how well I did at the shooting range where I had a perfect score.

 

Mr. Malatskey, however, given the fact that he was an excellent athlete and one most competent street fighter and an excellent swimmer to boot would have been considered by our “Madrichim”, the Israelis, men and women, with strong military backgrounds in charge of us, for a possible future position beginning with Israeli Special Forces units.

 

In fact there were a handful of us on both Ulpans, Roy Essakow based, as was half the South African Jewish spoiled rotten kids our age, at another Kibbutz, who one would have thought would “make the grade”, bearing in mind that having a “genius” mind was not all that necessary since Israel already had Einstein’s “intelligence” and what he may have forgotten to “download” before he passed away in 1955 didn’t matter in the least including all the reasons why not a single Jewish South African I knew in all the 21 years shy of one week I lived in South Africa ever came close to being considered seriously for any position in Israeli intelligence apart from Roy Essakow and one Durban Jewish South African who was not on Ulpan with us and did not in fact attend high school at our fully DAAC controlled Jewish day school, his name not very important at this time, as again Israeli Military Intelligence had everything figured out well in advance of the very first shots fired in Israel’s War of Independence that began immediately following the DAAC UN granting Israel Statehood on May 15th, 1948 within a month of the DAAC UN under the total “command and control” of the United States granting the South African Apartheid Regime unfettered access to the mineral riches of South Africa and in the process beginning the wholesale mass enslavement, torture and murder not just of the 40 million Black South Africans but all of Africa.

 

The genocide in Sudan is one of a long list of atrocities that can all be traced back to the DAAC 3 Branches of the United States Government interested only in stealing gold and oil wherever it is found.

 

Yes, the United States of America’s Supreme Court should be tried for Nazi War Crimes.

 

Besides for you and everyone carbon as well as blind copied understanding that people only need to know what they need to know there are in fact no coincidences in life including the decision by Ben Gurion to turn to South African Air Force Commander Judge Cecil Mango who did not participate in Israel’s War Independence, to provide immediately following the cessation of hostilities in 1949, the “blueprint” for Israel’s future most brutal Air Force that the world only got a glimpse of in the 1967 Israeli-Arab 6 Day War.

 

Given all the “intelligence” that is out there INCLUDING the Israeli Military Intelligence report that states categorically that following the 2008 Beijing Olympic Games Al Quaida will launch a series of attacks on the oil fields of Qatar, Kuwait, and Saudi Arabia that in the next instant will totally paralyze the U.S. economy, it is hard for anyone on Wall Street to be taken seriously when suggesting anything close to the “best is yet to come” unless they are talking about the masses who don’t benefit in the least from war.

 

“Peace” again is “war” to those who profit from war and Wall-47th Street understand this perfectly well.

 

It is not only every single Jewish South African, rich or poor who understands the “genius” behind Israel immediately following it’s War of Independence beginning to forge extraordinarily close military ties with the Apartheid Regime while the brain dead Jewish masses NOT ONLY IN South Africa held on for dear life to their highly anti-Semitic, anti-God, so very racist chant,

 

“If there was not a black problem in South Africa there would be a Jewish problem.”

 

Jewish people all over the world are only Jewish when it suits them, a point I am proving rather well for all the Gentles including Muslims.

 

To appreciate such a “genius” move by Israeli Intelligence requires the most minimal amount of common sense which those who clean the toilets and take out the garbage at our Ivy League Universities shouldn’t have much difficulty in helping faculty members find.

But I think you would agree it would be a nice thing for all those with big filthy mouths like Mr. Malatskey, Roy Essakow, Hilary Clinton, Bill Clinton, Marc Rich, Joe Lieberman, Howard Schultz and Co., each and every member of the United States Congress, each and every western teacher and professor beginning with kindergarten teachers to now be most contrite.
