Gary

Point 1

Agreed I see no problem with this and will keep you up to date on the start of trading which will not be immediate but will be relative to local authority permissions and with your approval some redecoration. I notice the one word reduction and agree again.

Point 2

lets say for ease of understanding all non alcoholic drinks. Excellent

Point 3

I am agreeing that any structural improvements  would be at the expense of myself/business and of course you are and would be the beneficiary as any improvements would be in existence at lease termination. Notice I threw in the letter t and agree.

Point 4

You ask that all expenditure relating to improvements be approved by you

As the finance for any improvements will be provided by myself I see no reason why you should approve or disapprove and that your permission to carry out improvements would be the only relevant thing which we would want in writing. Agree

Point 5

Agreed although weekly can be a ball ache if we get busy. I agree to be reasonable as well.

Point6

Naturally! Agree although I don’t recall the point but notice in my previous communication that I had responded, “Excellent”.

Point7

Naturally and refer point 4. Same response as to point 6.

Point 8

Gary I can understand your concern on this point But I can assure you that there is no litigation Scheduled nor do I have any solicitors instructed or retained in respect of my issues with Enterprise Inns

the situation is

Enterprise Inns entered into an agreement to reroof parts of the building as part of the lease support works . This work was to be completed within 6 month of the agreement it has yet to be done and as a result they have been charging rent on these areas which have not been able to be used .

This in turn has had a knock on effect on our trading potential has it would have been our restaurant and function room along with skittles.

They also agreed in to pay for some electrical work that I had done due to safety regulations I am still waiting for that.

Enterprise Inns also have 7500 sterling on deposit of my money .

Although I have issues with Enterprise so do almost all other Enterprise pub landlords in the uk

These issues do not and cannot have any bearing on our agreement if you would feel more comfortable than you can have the lease / agreement drawn up in my daughters name or another to be agreed. I will discuss with my attorneys and very much appreciate your clear articulation.

Point 9

Time is of the essence as I go on holiday 1st sept for 9 nights and again 18th sept for 7 nights and will be incommunicado for this time

As a foot note to this Gary   if you are uncomfortable with any of this then you should not proceed you mentioned the assignment looking like hell I am not sure how to take that [hell as well as heaven is here on Mother Earth] but let me try to assure you I want to move the food side of what we do I would like to be somewhere before Christmas

If it is becoming a problem for you then if you can let me know ASAP so that I can shelve the idea and start to look elsewhere

Whilst Sea crest is my preferred spot it is small and a difficult  shape to work with not to mention off the beaten track for passing trade despite this I belive it can work. Why not provide the free use of bicycles as well as a backpack that contains sparkling fresh water for your pub patrons so much so that by the time they arrive at Seacrest some 200 meters down the road not only are they sober but this long row of moving neon flashing billboards will have attracted folks across the Bristol Channel in Wales who in turn will have all law abiding alcoholics as well as non-alcoholics to charter a ferry and before we know it you will be back in the movie business?

You ask why don't I use the money we made from the sale of cvc studios well quite a lot of it is tied up in equipment and the refurbishment of The Red Lion

and under the terms of my lease I am not allowed to sell or reassign until November 26 2006 if at some point I can realise this we would be interested in looking at the purchase but first things first lets get it working !

I will now hand things over to Risdonhosegood.

Ps – Let me know if John M. Ramos, wealth manager for B of A, drops by, not to mention such a title very possibly dreamed up after Bank of America’s Board of Directors saw fit to read Alan Greenspan’s awesomely brilliant essay, GOLD AND ECONOMIC FREEDOM written in 1966 prior to him being corrupted and then approved as Chairman of the DAAC Federal Reserve.
