Subject: HAVE I MADE MY POINT? .... RE: Kirk, are you interested in a class action lawsuit I am preparing against American Airlines?

Given you knowledge of my “risk assessment” skills could you recommend someone bearing in mind I have already done significant “prediscovery” work that wouldn’t take much time for anyone as skilled as you to write a formal complaint, not to mention the following:

My loss which I would be able to prove to a “jury of my peers” is about $40,000, made up mostly of gold bullion.

Not to mention such a number has never been previously mentioned to Mr. Terry.

Second, in interviewing staff of American Eagle as well as employees of TSA, the security agency contracted by the San Diego airport authorities, they are all aware of the significant weaknesses in the internal controls that are so very “convenient”.

For example, in addition to TSA apparently not keeping for more than half an hour a photographic record of what passes through the x ray machine there is no notification when you check in beforehand at American Eagle, and very possibly the other commuter airlines, that your hand luggage will be taken from you after you pass through security and just before you board the plane.

Second, there is a gap next to the screener viewing what it is in your hand luggage.

Such a gap is not known to the passenger going through the mettle detector who is not only made to feel like a criminal but is often times distracted when asked for their boarding pass as well as on occasion ID which is often times in the hand luggage causing more of a delay for someone standing next to the screener and viewing exactly what is of value, to have all the time in the world to grab those valuables and/or inform the hand luggage baggage handlers.

Moreover, while relatively large amounts of cash and gold bullion which I carry with me most of the time when I travel is opaque and therefore you would expect the screener to ask to see exactly what it is, most of the time I am never asked and the gold just passes through without any objection.

Not to mention it will be interesting to see how many reports Mr. Terry has made to the TAS and other authorities like the FBI for when people like Black Hatter Mr. Leviev move billions of dollars worth of diamond currency all around the world?

Not to mention the use by DeBeers of the postal service.

To mention little of my decision following increasing physical threats to my 4 Ps, People, Pets, Property and Plants to disclose a “fair amount” of “my hand” which of course provides Mr. Terry and American Airlines a “Heads up” to do exactly what else apart from further “cover up”?

In the words of your colleague Mr. Jeffrey R. Krinsk Esq., Mr. Terry is either incompetent, culpable or both, take your pick?

BTW, when my wife and I returned to San Diego on the same airline while going through security up in Los Angeles I overheard the gentleman in front, a man with a foreign accent, telling the person ahead of him how his passport had been taken out of his hand luggage when he previously went through security and that he reported this incident to the “authorities” in order to get a new passport but he refused to give me his name, his reasoning, “I am in enough lawsuits.”

I understand fully, as you well know, how the “real world” works but surely there is going to come a point in time, very soon, when even you are going to have to ask yourself how much longer can all this nonsense of each of us only willing to stand up and “fight the right fight” when it comes “knocking at our door.”

The rest of the world, i.e. those living outside of the United States who pay a much higher price for their gasoline thanks to our oil wars which result in not only having our oil tyrants continue but for not much longer to accept our increasingly worthless currency but allowing us to maintain our military bases on their soils which serve as both a “gun pointed to their heads” as well as a “gun pointed to the heads” of their second-in-command not to “jump the gun”, are beginning to question ever more carefully exactly what is going on as they rid their economies of being dependant on an out of control military-industrial-complex.

Such aware, i.e. sensitive people living on the front lines of our induced refugee crises throughout the world not just in Iraq and the Balkans are also looking at everyday mundane things like international travel guides which don’t currently point out all the risks for Americans and foreigners traveling within the United States.

Have I made my point?

NOT TO MENTION how it comes about in our country that prides itself on being the strongest proponent of “FREE TRADE… FREE ENTERPRISE SYSTEM… FAIR MARKETS… FREE MOVEMENT OF CAPITAL… FAIR TRADE PRACTICES [UNLESS YOU ARE THE DEBEERS-ANGLO AMERICAN CARTEL] … A NATION OF LAWS-LAWYERS… “ [sic], so very important the notion of “RULE OF LAW” and the importance of “MAINTAINING LAW AND ORDER” and never to forget how we so self-righteously comment, “VIOLENCE IS NEVER THE ANSWER” or better yet pontificate on “THE PUNISHMENT MUST FIT THE CRIME”, a general manager of a major New York Stock Exchange corporation when not able to come up with answers to very reasonable questions following his previous beyond belief laughable email would CHOOSE so very poorly to call me up in the sanctity of my dwelling to threaten to intimidate.

Moreover, can you share with me any law on the books of the United States preventing United States citizens from taking out of the U.S. as much money as they want.

To repeat what Mr. Terry said to me earlier today when he called so unrepentantly;

Why it is that you are traveling outside of the country with so much money?

Gary, this situation is not something I could handle.  My firm is very busy with other work and we are trying to curtail taking on any new matters, especially ones like this which are outside our traditional areas of expertise.  Thank you for think of us, but I must decline.  Kirk

You caught me just as I was about to send a response to the general manager of American Eagle that owned by American Airlines.

Rather than have me explain it all let me have you take a look at my draft response to his phone call earlier this morning as well as all the “back and forth” between him and me.

MR. TERRY, WHY TERMINATE THE PRECISION OF EMAIL TO CALL ME at 8:56 AM PST, the call lasting 2 minutes and 56 seconds just to let me know that the decision taken by your superiors is to now hand this matter over to the TSA for them to investigate “Why it is that you are traveling outside of the country with so much money?”?...

Subject: Why weren't the passengers notified immediately while the plane was still on the ground that there was a "problem" with valuables separating from their hand luggage?

Bear in mind the passengers numbered no more than 20 and were seated very patiently having never been advised until we got to the steps of the plane that our hand luggage would be taken out of our possession, not to mention hand luggage that had been passed through x ray machines which would have kept a digital photo for how long you think?

Why weren’t the passengers notified if not in flight then immediately when we arrived in Los Angeles some 30 minutes later?

Furthermore, I assumed that since you emailed me on Saterday you were focused as I am in getting to the bottom of this rather unfortunate incident.

Did you ever receive an “incident report” I filed with your parent company, American Airlines over the Internet?

Did you file any report with your superiors?

Did your baggage handlers tell you how much money was “returned to the only bag that was unzipped”?

How much time would you say was spent going through all the passengers’ luggage to make certain that no other bags were unzipped?

Please run by me, since you were on the scene picking up the gold, what thoughts were going through your mind as the best and most efficient way to notify the passenger who you would have assume was oblivious to all the fuss going on below, of their “misfortune”?

Have you thought to ask me how much gold as well as a 1909 Lincoln penny is missing?

In all the years you have worked for both American Airlines and American Eagle have you ever come across small gold nuggets just lying on the Tarmac?

Have you read the most current editorial in the back of American Airlines’ in-flight American Way magazine, page 124 titled, Liar, Liar?

Mr. Gevisser,

With all due respect I talked to you on Friday April 27 consequently I am off on weekends and returned today Monday April 30th.  As you probably know when you take off for two day’s there is two day’s of work piled up waiting to be completed!

It is very unfortunate that someone had left a pocket unzipped and their money and this gold fell out.  The money was found immediately and returned to the only bag that was unzipped, but unfortunately the gold was not seen until the aircraft was closed and ready for departure.  What was found was several little gold pieces and one small gold bar (with 14K printed on it).  After the aircraft pulled out what gold we saw on the ground was picked up and placed in an envelope and immediately put into our safe.

If you have any questions please do not hesitate to contact me.

Steve

Bear in mind the first thing you told me when we spoke for the second time on April 27th, the 7 minute and 36 second phone call beginning at 10:49 AM Pacific Standard Time how very “saddened” and “concerned” you were when your baggage handlers rushed in to your office to notify you of the all the gold that had “fallen” out of my hand luggage that then caused you to rush down to the plane, still standing on the tarmac, before getting on your “hands and knees” to pick up from on the ground as well as what was in the plane what amounts to the most extraordinarily small amount of gold that was, also in your words, “retrieved”.

Consequently I assume, at a minimum, you would personally know if what appears to be a coin in the envelope which again I have yet to open, is one of the 10 one ounce gold coins that were in a tightly sealed hard plastic container?

Time is of the essence!

Why is it taking so long for you to respond to this straightforward question?

Was one gold coin part of what was recovered?

Also do you recall where most of the gold was recovered bearing in mind the flight left at 5:55 PM on April 3rd?

I cannot tell you the exact weight but what is in the envelope is what was recovered.

I thought it best that I leave it unopened so that when I make my claim there will be no doubt as to what Janet handed over to me.

In feeling the contents it seems like there is a 1 oz gold coin.

Is that the case?

Gary
