So that it's clear, my comment was to the effect that she has no veto authority
over the Regents, not that she did not care or was not interested. The
difference between this and the smog fee award is that the Board of
Equalization, of which the Controller is a member, was a defendant in the smog
litigation. Therefore, as a defendant that had been ordered to pay, she
resisted and prevailed. Her distain for the Milberg firm is well
documented. As I stated before, you are entitled to your opinion and we
will just have to agree to disagree.

I received your
responsive communication but my erroneous assumption was that Ms. Connell could
exercise sum influence and was persuasive in directing the financial affairs of
California. My disappointment in learning that she has no authority or
influence or interest in pursuing this matter accurately completes my picture
of her motivations.
It is somewhat sad and a
stark contrast to the publicity she disseminated in conjunction with
effectively controlling the payments of fees in the smog lawsuit and took
credit for controlling events under those circumstances.

I appreciate your
response but must respectfully indicate my disagreement. While not designated a
regent Gray Davis and Bustamente are Regents and Ms. Connell their Chief
Financial Officer. Milberg Weiss represents the Regents and Officers of the
University of California that has been appointed lead plaintiff in the lawsuit
against Enron. Gray Davis is the president of the Officers of the Regents with
John Moores the Vice Chairmen.
As Governor Davis' Chief
Financial Officer for the State there is no justification for Ms. Connell
permitting this situation to continue where the ex Officio Regents include the
principal executive officers of the State the de facto ability to prevent
Milberg's representation on behalf of the Regents and thereby the State.

The Controller did not
vote "to support Milberg Weiss' representation of the California
University Regents" in the Enron matter. The State Controller is not a
member of the Regents. It is
possible that you are referring to the lawsuit filed by Milberg on behalf of
the California Public Employees' Retirement and the State Teachers' Retiremen
Funds against WorldCom. If so, the
decision to use Milberg was a decision of the staff of those two retirement
boards. The Controller and the
other members of the Board voted to file a lawsuit. The Controller's distain forthe Milberg firm in the WorldCom
suit was printed in several newspapers, including the August 3, 2002, edition
of the San Francisco Chronicle. As
stated in the newspapers, the Controller expressed her dissatisfaction with
using Milberg under any circumstance.
However, the staff and the other 12 members on the CalPers board refuse
to drop the firm from their proprietary list of attorneys.

Controller, Kathleen Connell, was forwarded to me for reply.
The State Controller
appreciates the fact that you concur with her decision to challenge the
arbitrator's award in the smog impact fee case and was quite pleased with the
recent judicial decision over turning the award. Contrary to a statement made
in your note to Mr. O'Brien, Ms Connell's assistant, Ms. Connell has not
accepted any contributions from Mr. Bill Lerach or any other partner with the
Milberg firm. Also, Kathleen
Connell will be leaving office at the end of this year and plans to return to
private industry. As such, she
will not be seeking any other elected office at this time. Thank you for your interest and support

Dear Mr. Obrien,
I apologize if I
misspelled your name butt I am getting a little frustrated trying to get hold
of Ms. Kathleen Connell our State Comptroller? I don't know what the difference
is between the words "comptroller" and "controller" butt
both words cause my head to buzz. I see "stroller," "con,"
"Enron" even "Entron" which was I heard “tiear”[sic] first
choice, and then there is "comp" yet competency seems the furthest thing
that comes to mind and God knows that to lose one's mind is rather sad, a
"word apart from monkey business " [sic]. AND once you have
"competency" then it starts getting much easier because then we have
words like "regency"
and to be a "regent" or not to be is the question. I once tutored
business-finance at university butt suffice to say I failed.
Back on August 7th after
leaving several messages for her I sent one of her supposed assistants Mr. Dave
Gomez an email which you can see below. I never heard back. Today, I called
what I thought was Mr. Gomez's office [310-342-5678] and was told by the
receptionist to call another number, 310-4477707, which is disconnected. This
lady was really trying to help me and she suggested that I email you.
There is nothing I
detest more than those who derive great enjoyment in testing my impatience to
mention little of those who derive great thrills exceeding the limits of their
small but thankfully, limited authority, i.e. evil doesn't appear out of the
blue with a color coordinated red pointed tail and a white pitched fork. I
happened to be watching the news back on July 23rd at approximately 11:50 PST
when a picture appeared on the TV screen of Martha Stewart holding a pitched fork.
It was either CNN or the Fox Network. Mr. O Brian do you really believe that
sheep would be fooled by a wolf donning
a sheep skin's jacket?
I really don't have the
time to heckle with politicians and that is why I was most impressed to see the
stand Ms. Connell took vis si vis Milberg Weiss who no doubt have contributed
somewhat to her fund raising drives. Moreover, her stand to stop the governor's
payroll check is no doubt more of a feather in her cap. I truly believe the
time is fast approaching when women will have a shot at the brass ring just as
they did back during the time of Pythagoras.
God knows what Martha
Stewart is going to look like come this October 23rd just a couple of weeks or so
before the upcoming gubernatorial elections butt I want to do my best to see to
it that Ms. Connell at least is sitting
pretty. Last October 23rd was quite a day to remember. Again, I think Ms.
Connell would welcome my insight.
Please be so “find
figure” [sic] as to print out all the hyperlinks for Ms. Connell and let
her also know that I played a hand in getting a class action lawsuit filed
against a less fortunate Fortune
100 company with less than two hours to go before the statute of limitations
ran out. Ms. Connell may also appreciate the fact that I can play both sides of
the fence in my pursuit of justice
and I am also ambidextrous, i.e. Judge Jack Weinstein a not-altogether-insignificant
judge back east credited
me for the role I played in stopping the "floodgates"
from opening up and sending workers compensation claims sky-high, insurance
awards often artificial light robbery to mention just in passing what is going
on behind the scenes at Kmart today as the folks scramble to mention little of
the fact that I tTOo consider the Milberg Weiss folks less than I do my dog and
they have helped butter my bread somewhat, less said though the better, better
yet we should put pen to paper and make sense of what we say and of course we
all believe in the power of the mighty dollar although the stock market may
very well become a relic, all
shriveled up, dressed to kill and not a "date
in site" [sic]..
My "step kid"
had scrambled eggs for "breakfeast" [sic] today but as you see I am
not someone accustomed to skating on thin ice.
I see no problem though in eating eggs especially if one uses the shells for good
effect. Now I could have cropped the photo of this side table with eggshells
imbedded on its top; moreover I could have eliminated the flash altogether and
you would see the table is in better condition than what it now appears to be
butt then you wouldn't see all the wires hanging around me as well as some of
my prized art collection. Moreover, I am frankly in a rather hurry and I don't
really have the inclination to futz around. I still have to take my "god
Pypeetoe" [sic] out for his second daily exercise routine and both of
us have yet to attend church services across the lane from where I live. I
sometimes let him out and he disappears for quite sum time butt upon returning
he seems totally rejuvenated.
I am pretty certain Ms.
Connell would enjoy my "bottoms
up" schooling approach to solving the problems of bad parenting. She
may also be pleased to know that I know how to hold a knife and fork. My mother
taught Charm School and raised beauty queens from picking them up off the
beaches of South Africa. My grandfather built up an empire by first bending
down and picking up unbroken bottles of the streets of Durban, South Africa
before depositing them in a broken down wheelbarrow butt he got wind early in
life the importance of a good name and credit to boot. It was just a question
of time before I would become laser focused and begin cleaning up Wall Street
while making sum change along for the ride?
Ms. Connell may be
interested to know that not everyone gets on with me butt in the end they all
get it. Even Governor Davis will eventually get his comeuppance, certainly he should
think a little harder before sitting foot on a "mock
surfing bored" [sic]. Moreover, he should first chew on his words
before uttering such pitiful comments. I have yet to see a retraction in the
“Del Mar X” [sic] down here in serfers' paradise
I believe in guiding
kids right from the start and then getting out of the way. Both "step
children" are rather precious, Jonathan though is the more adventurous
butt his sister Danielle watches over him ever so closely. It would be nice if
they were to avoid passing on the man made viruses that afflict us all from
being the best we can be. Tank tops a whole lot better alternative to getting
involved in other people's wars. Although I am not married to their mother the
"step children" remain one step ahead of me aware that when I mean
business I mean business butt mostly we just horse around they guide me to
parent right.
I tTOo know "write from left"
[sic] although I write with my left butt I serve tennis though with my right
and I can still kick a pretty good ball with either foot butt I prefer my right
over my left; friends I keep close butt mostly I keep to myself. I don't
subscribe to many of the notions that get folks all mixed up including the one
"My enemies enemy is my friend." It is time for folks to take the
sleep out of their eyes and ponder less their navels and empower their children
right from the start.
I am in the process of
writing my fist book. It is titled Manager Minute One that we should be our own
managers from the get go. When push comes to shove I can also use my "right"
[sic], perhaps though not as well as one of my headmasters. You have to scroll
down to the bottom of the page to see "Mr. Fleming" [FLM
sic] but I can assure you he was quite the man. You wouldn't want to go a-round
though with either of these tTOo gentlemen although the gentleman on the left
is, as "my travel
companion" would say, "very sweat." My one-step-ahead kids'
mother really knows her stuff and is today very worldly to boot and knows best
how to deal with my gobbledygook "buy simply going blah blah blah"
[sic]. Recently she informed me that the word "gobbledygook" is in
the dictionary. I couldn't know since I never let my formal education or lack
thereof stop me from asking the most important question,
What is it that causes
folks on the far right and the far left who feed off each other, often even
making love to one another, to want to kill everyone in between, i.e. a "Dutch sandwitch"
[sic]?
Please let Ms. Connell
know that I may have figured this one out butt she would have to agree to meet
me for lunch before I spill the rest of the beans.
I try very hard not to
mix business with the more important stuff of raising kids right butt business
is not just a fact of life, it is life itself because when we touch people
right, when we do a good deal, we pass on the same senses that makes us all
tingle when we see a beautiful flower, or a woman to die for; certainly I would
rather have a healthy woman at my side to protect me than some guy whose first
reaction would be to protect his genitals. I have though very good male friends
as well.
I mostly though, simply
stick to my knitting but if necessary I am very capable of delivering "a perfect write" [non-sic].
Please let Ms. Connell know that I come in “piece”
[sic] but in the end I let the evidence do all the talking.
Although she and I have
never met I once nearly joined her for a private dinner where "Mr. Sniff=ING"
[sic] was present. Naturally his "travel
companion" at the time, Ms. Vicky Schiff played host and her
co-managing partner at Wetherly Capital, Mr. Dan "big
mouth" Weinstein later fired up a storm. I believe Ms. Connell would
know what I am talking about. It was, however, Ms. Schiff who gave me the blow
by blow.
Unless I hear from Ms.
Connell in short order I will take my cue from my dog. Enough said.
